1 GENERAL PROVISIONS

  1. These Regulations shall apply to the Training organised by Maciej Cićkiewicz (Dental Movies Maciej Cićkiewicz), Osowska 70/72/3, 04-332 Warsaw, NIP [Taxpayer ID No.]: 1132570226, REGON [Business ID No.]: 141665782.
  2. The Organiser carries out the Training within the scope, at dates and prices specified in the training offer available on the Organiser’s website: www.academyoforthodontics.com.
  3. The terms used in these Regulations shall have the following meaning:
  4. Consumer – Applicant who is any natural person performing a legal act which is not directly related to his business or professional activity;
  5. Training materials – all materials prepared by the trainer or the Organiser which are presented during the Training, as well as materials received by the Participant as part of the Training;
  6. Organiser – Maciej Cićkiewicz (Dental Movies Maciej Cićkiewicz), Osowska 70/72/3, 04-332 Warsaw, NIP [Taxpayer ID No.]: 1132570226, REGON [Business ID No.]: 141665782;
  7. Training – training involving practical dental courses, theoretical dental courses and medical courses and consultations intended for dentists, dental technicians, dental hygienists or other persons involved in running a dental practice or the dental market, which is organised by the Organiser in accordance with § 1(2);
  8. Participant – an individual who was signed up for the Training and for whom a training fee was paid;
  9. Agreement – an agreement concluded between the Organiser and the Participant on the terms and conditions set out in these Regulations;
  10. Applicant – a natural person, legal person or an unincorporated organisational unit, signing up a Participant or Participants for the Training and obliged to pay the fee for the Training. The Applicant may also be a Training Participant.

 2 SIGNING UP FOR THE TRAINING

  1. In order to sign up a Participant for the Training, the Applicant is obliged to fill in an online application form available on the Organiser’s website: academyoforthodontics.com and to pay the fee for the Training in accordance with these Regulations.
  2. The Training application should contain the details of the Participant: name, surname, telephone number, email address and precise indication of the Training course to which the application refers. The Organiser reserves the right to reject an application which lacks any of the above information.
  3. The application must be submitted no later than 7 business days before the scheduled date of the Training. After the lapse of the above time limit, the Participant may be signed up for the Training upon obtaining a prior consent of the Organiser over the phone.
  4. After receiving the application, the Organiser shall confirm its receipt by means of a notification sent to the Applicant’s e-mail address, containing in particular the Organiser’s data, information about the scope, place and date of the Training.
  5. The Agreement shall be deemed concluded upon the receipt by the Applicant of the notification referred to in paragraph 4.
  6. The number of Training Participants is limited. The Participants shall be signed up for a given Training course on a first-come, first-served basis.
  7. If the Applicant wishes to receive a VAT invoice for the Training fee, they should provide all the data necessary to issue the invoice.
  8. By sending the Training application, the Applicant accepts these Regulations and agrees to be contacted by the Organiser by e-mail, fax or telephone for the purposes related to the Training.
  9. Failure to pay the fee for the Training within 3 days from the date on which the Organiser has confirmed the receipt of the application entitles the Organiser to reject the unpaid application without prior notification of the Applicant.
  10. Should the number of Applicants for a given Training course exceed the number of admissible participants, the applications submitted after the list is closed will be placed on a standby list, of which the Applicants will be notified immediately.

3 TRAINING SESSIONS 

  1. The training may take the form of a theoretical lecture, a lecture and a presentation, a lecture and a practical workshop, or other classes. The form of the Training shall be determined by the Organiser together with the trainer.
  2. Training sessions take place on dates and places specified in information/advertising materials or on the Organiser’s website: academyoforthodontics.com.
  3. The Training sessions are conducted by trainers with appropriate qualifications and competences. Information about the trainer may be found in the information/advertising materials or on the Organiser’s website: www.academyoforthodontics.com.
  4. The Organiser reserves the right to change the trainer for the Training, ensuring however the same level of competence of the new trainer. The Participant or the Applicant shall not have the right to demand the reimbursement of the training fee due to a change of the trainer.
  5. The Organiser shall have the right to change the date or place of the Training. In such a situation, all Training Participants will be notified about the introduced changes by e-mail or telephone.
  6. In case of changing the place or date of the Training, the Participant has the right to sign out of the Training within 3 days from the date of receiving notification about the planned change, and the Organiser undertakes to reimburse the whole fee paid by the Participant for a given Training.
  7. Where a Training course is cancelled for reasons beyond the control of the Organiser, including an event of force majeure, the Organiser will conduct the Training at another, designated date, without charging additional fees to the Participants. The Participant has the right to withdraw from the Training within 3 days from the date of receiving notification about the reason for changing the date or place of the Training, and the Organiser undertakes to reimburse the whole fee paid by the Participant for a given Training.
  8. The Organiser reserves the right to introduce minor modifications to the Training Plan without prior notice to the Participants.
  9. The Training materials prepared by the trainer are intended for Participants’ private use only. The Participant acknowledges that the Training materials are protected by copyright, and any use of the materials other than private use, without the consent of the Organiser, is prohibited.
  10. Each of the Participants receives a Training certificate issued by the Organiser after the completed Training and, in the case of courses registered in the Chamber of Physicians and Dentists, a Training certificate specifying an appropriate number of credit points.
  11. The Training Participant shall refrain from recording the classes with any audio-visual devices without the consent of the Trainer and the Organiser, otherwise the Participant may be removed from the Training without the right to a refund.
  12. The Training sessions may be recorded by the Organiser and made available online for complaint/marketing purposes.

4 FEES

  1. In order to participate in the Training, the Applicant or Participant are obliged to pay the fee within 3 days from the date on which the receipt of their application has been confirmed by the Organiser, according to the data sent by the Organiser. Failure to pay the fee shall not constitute a withdrawal from the Training.
  2. The Organiser charges a fee for the Training in advance. The payment should be made on the basis of a VAT invoice, which will be sent by electronic means or by fax to the Applicant.
  3. The Training fee may be determined in PLN or EUR. Where the fee is determined in a currency other than PLN, the amount of the fee will be converted into PLN at the average NBP rate.
  4. Information on the amount of fees for particular Training sessions, any instalment plans and instalment due dates is available on the Organiser’s website academyoforthodontics.com. The amounts indicated as Training fees are gross amounts.
  5. The Training fee covers: participation in the Training, materials used during the Training and a Training certificate as well as the costs of meals and beverages offered as part of the Training. The Organiser shall not cover the costs of the Participant’s travel to the place where the Training is held and the Participant’s accommodation.

  1. Any reimbursements of fees paid by Participants or Applicants under these Regulations shall be made by the Organiser by transfer to the Participant’s bank account from which the fee was paid.
  2. In order to participate in the Training it is required to make payment within the time limits specified in these Regulations.

5 WITHDRAWAL FROM THE TRAINING 

  1. The Participant has the right to withdraw from the Training. Please send your withdrawal notice to an email address: info@academyoforthodontics.com.
  2. Where the notice of withdrawal from the Training is submitted within 14 business days before the scheduled date of the Training, the Organiser shall refund 70% of the paid amount to the Participant.
  3. Where the notice of withdrawal from the Training is submitted less than 14 days before the date of the Training, the amount paid shall not be refundable.
  4. The person submitting a withdrawal notice shall be removed from the list of Participants upon the confirmation of the Organiser sent to the e-mail address of that person.
  5. Absence of the Participant from the Training without prior formal withdrawal notice does not release them from the obligation to pay 100% of the Training price, unless the Participant proves that the absence from the Training was due to reasons not attributable to the Participant.
  6. The provisions of paragraphs 2-5 do not apply to Participants who are Consumers.
  7. A consumer who concludes a distance contract may withdraw from the Contract within 14 days without giving any reason.
  8. The Consumer may withdraw from a Contract by serving the Organiser notice of withdrawal. The notice can be submitted using the model withdrawal form attached as appendix no. 1 hereto. The time limit shall be considered observed if the notice is sent before the time limit ends.
  9. In cases of withdrawal from a Contract, the Contract shall be deemed not to have been concluded.
  10. The Organiser shall immediately, not later than within 14 days from the date of receipt of the Consumer’s notice of withdrawal from the Contract, reimburse the Consumer for the amount paid, reduced by the actual costs incurred by the Organiser related to participation in the Training.
  11. The Consumer shall not be entitled to withdraw from a distance Contract where the Organiser has fully performed the Contract with the Consumer’s explicit consent, and the Consumer was informed before the commencement of the service that they would lose the right to withdraw from the Contract upon the completion of the service by the Organiser.

6 COMPLAINTS

  1. Any complaints regarding the Training may be filed by Participants via email: info@academyoforthodontics.com and in writing to the address of the Organiser’s office.
  2. The complaint should contain the details of the Participant filing the complaint, including the name, surname, correspondence address, e-mail address and telephone number, the subject of the complaint and its justification.
  3. The Organiser shall handle the complaint within 14 business days of its receipt.
  4. The Organiser has the right to extend the time limit referred to in paragraph 3, having previously notified the Participant filing the complaint about the new time limit.
  5. The complainant shall be notified about the decision regarding the complaint in the same form in which it was filed.

7 FINAL PROVISIONS 

  1. Any matters not regulated by these Regulations shall be governed by relevant provisions of the Polish Civil Code, the Act of 30 May 2014 on Consumer Rights, the Act of 18 July 2002 on the Electronic Provision of Services and other provisions of Polish applicable law.
  2. These Regulations shall enter into force on 20 April 2020.
  3. The Organiser reserves the right to amend these Regulations.
  4. The Participant consents to having their image recorded in photos or video materials from the Training used by publishing it on social media profiles of the Organiser.
  5. Amendments to the Regulations do not apply to applications submitted and paid for before the effective date of such amendments.
  6. In the event of any discrepancies between Polish and English versions of the Regulations, the Polish version shall prevail.
